By creating a MailPulse account, installing the MailPulse Chrome extension, or otherwise using MailPulse (together, the "Service"), you agree to these Terms of Service. If you are using MailPulse on behalf of an organization, you confirm you have authority to bind that organization, and "you" refers to both you and it. If you do not agree, do not use the Service.
MailPulse is currently offered as beta software. By using MailPulse you acknowledge it is under active development and may change, break, or be discontinued without notice. MailPulse is a Chrome extension and web dashboard that helps you see engagement signals (such as opens and link clicks) on emails you send from Gmail, using a tracking pixel and rewritten links - not by reading your mailbox. See our Privacy page for exactly what is and isn't collected, and its Tracking limitations section for what an activity signal does and doesn't prove.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use MailPulse. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you become aware of any unauthorized use of your account.
You agree to use MailPulse only for legitimate email engagement tracking on emails you send yourself, and not to use it to harass, deceive, stalk, or surveil recipients beyond standard business email-tracking norms. Without limiting the above, you agree not to:
We may investigate suspected violations of this section and take action including warning, rate-limiting, suspension, or termination of an account.
You retain ownership of the content you send through the Service. You represent that you have the right to send the emails you track and that doing so does not violate any agreement or law binding on you. See our Privacy page for what MailPulse collects and how it is used, and for how to delete your data.
MailPulse offers paid subscription plans (Track, Engage, Business) in addition to the Free plan - see our Pricing page for current plans and pricing. Where a paid plan is not yet purchasable (for example, while we are still finishing payment setup), the Pricing page and checkout button will say so plainly rather than accept a payment we can't yet process.
Paddle is our payment provider and Merchant of Record. All payment processing for paid plans is handled by Paddle.com Market Ltd ("Paddle"), not by MailPulse directly. As Merchant of Record, Paddle - not MailPulse - is the seller of record for your purchase: Paddle processes your payment, collects and remits any applicable sales tax, VAT, or GST for your jurisdiction, and is who your card statement will show as the merchant. MailPulse never receives or stores your card number or other payment credentials. By subscribing to a paid plan you also agree to Paddle's own buyer terms, in addition to these Terms.
Billing cycle. Paid plans are billed monthly in advance from the date you subscribe and renew automatically each month unless canceled.
Cancellation. You can cancel at any time from Settings > Plan & Billing > Manage billing, which opens Paddle's hosted billing portal. Canceling stops future renewal, but your plan and its entitlements stay active through the end of the billing period you already paid for - we do not prorate or immediately revoke access when you cancel. At the end of that period your account automatically reverts to the Free plan and its usage limits; your account itself is not deleted and no tracked data is removed as a result of a plan change alone (see our Privacy page for how to delete data separately).
Failed payments. If a renewal payment fails, Paddle automatically retries it for a period before giving up. Your plan and its entitlements remain active during that retry window. If every retry fails, the subscription is canceled and your account reverts to the Free plan, as described above.
Refunds. Because Paddle is the Merchant of Record for your purchase, refund requests are handled by Paddle under its own refund policy. You can reach Paddle directly using the link in the receipt it emails you or via the billing portal (Settings > Plan & Billing > Manage billing), or contact us using the address on our Privacy page and we will help route the request.
MailPulse is provided "as is" and "as available," without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Activity tracking is a best-effort technical signal and is not guaranteed to be accurate, complete, or uninterrupted. We do not warrant that the Service will be error-free, secure, or available at all times.
To the maximum extent permitted by applicable law, MailPulse and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of, or inability to use, the Service, even if advised of the possibility of such damages. To the maximum extent permitted by applicable law, our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the three months preceding the claim, or (b) fifty US dollars ($50) - so on the Free plan, where nothing is paid us, the cap is the latter. Nothing in these Terms limits liability that cannot be limited under applicable law.
You may delete your account at any time from Settings, which removes your tracked messages, events, contacts, and follow-ups as described on our Privacy page. We may suspend or terminate accounts that violate Section 4 (Acceptable use) or that we reasonably believe pose a security or legal risk to the Service or other users. We may also discontinue the Service, or specific features of it, at any time during this beta period, with notice where reasonably practicable. Sections of these Terms that by their nature should survive termination (including Sections 7, 8, and 11) will survive.
Because MailPulse is in active beta development, features, limits, and these Terms may change. We will make a reasonable effort to flag material changes (for example, via the dashboard or the email on file for your account) before they take effect. Continuing to use the Service after a change takes effect constitutes acceptance of the updated Terms.
Placeholder pending legal review. MailPulse is currently operated from Mauritius, so our working assumption is that these Terms would be governed by the laws of Mauritius, without regard to its conflict-of-law principles, and that disputes would first go through good-faith informal negotiation before any formal proceeding. This section is intentionally provisional: the correct governing law, venue, and dispute-resolution mechanism (including whether arbitration is appropriate) depend on where our paying customers are based once billing launches, and must be confirmed by a qualified lawyer before this beta becomes a commercial, publicly-marketed product.
